NJ Rifle & Pistol Clubs Sue to Overturn State’s Unconstitutional Handgun Carry Law

New Jersey – -( The Association of New Jersey Rifle and Pistol Clubs announced today that it has filed suit in federal court to overturn New Jersey’s draconian restrictions on carrying a handgun outside the home for self-defense!

Under New Jersey law, a permit to carry a handgun may be issued only to those citizens who show that they face a unique need for self-defense – such as specific, documented death threats or actual attacks. Ordinary citizens are barred from carrying a handgun outside the home for self-defense, under threat of up to 10 years in prison.

The new lawsuit seeks to overturn New Jersey’s carry law on the ground that it violates the Second Amendment.

In the landmark 2008 Heller decision, the U.S. Supreme Court held that the Second Amendment protects the individual right to keep and bear arms for self-protection, and it struck down a District of Columbia law banning the possession of firearms in the home.

“The core Second Amendment right of armed self-defense is just as important to an ordinary New Jersey citizen when she is traveling through a dangerous neighborhood as it is when she is safe in her home,” said ANJRPC Executive Director Scott Bach. “The Supreme Court has said that the States cannot ban people from keeping firearms for self-defense in their homes, and New Jersey’s restrictions on carrying firearms outside the home will meet the same end.”

Federal courts in New Jersey have previously upheld the State’s restrictions, but the new lawsuit-which was filed in cooperation with the National Rifle Association, asks the courts to take another look at the issue, based on a recent federal decision striking down the District of Columbia’s similar law as flatly unconstitutional.


“We thank the NRA for its incredible support and guidance, which made this new lawsuit possible,” continued Bach.

“The Supreme Court has repeatedly held that police have no legal duty to protect individual citizens from harm, which means you’re on your own in an emergency,” Bach continued. “The same government that abandons its duty to keep you safe should not also block your Constitutional right to protect yourself. Right to carry’s time is coming in the Garden State, and Association of New Jersey Rifle and Pistol Clubs and NRA are at the forefront of that movement.”

  1. When are you going to go after the metro counties in Ca for the same thing? There are many more NRA members in Ca than in NJ, yet the NRA does nothing here.

  2. The NRA needs to go back and get the 1934 anti-gun law voided as unconstitutional. Then, all laws passed after that should also be voided for the same reason. Our 2nd Rights should not be negotiable at the Federal or State or Local level. NO infringement on our Rights! I’m a Life Member of the NRA, Patron Level. The NRA needs to stay on the offense and NOT defense! NO war was ever won on defense..

  3. And I will bet they allow career criminals to plea bargain when they are caught with guns. These people are worse than dictators because they would rather control people than make the necessary effort to actually control crime. I live near a city when citizens in certain neighborhoods are banding together to combat “gun violence”. Parents have to talk to their children they say. True, but first they have to stop them from using drugs or participating in the sale of same!! Viola, reduce drugs and somehow magically you reduce “gun violence” May not be applicable to N.J., but it the example of ASS BACKWARD thinking. I lived in Philly for 30+ years so I am familiar with the “GardenState”.

    1. these states that will not let us carry outside of our homes should have all there body guards that protect the officals disarmed just like us the people who put them into office . the amount of killers let out of jail each year is so bad that i cant stand it .

  4. Maryland has a similar carry law which should be looked at as well. Maybe Maryland’s Republican governor should do something about that.

      Consider this often-cited passage, from Part Three: 6 February – 7 September 1942:

      “The most foolish mistake we could possibly make would be to allow the subject races to possess arms. History shows that all conquerors who have allowed their subject races to carry arms have prepared their own downfall by so doing. Indeed, I would go so far as to say that the supply of arms to the underdogs is a sine qua non for the overthrow of any sovereignty. So let’s not have any native militia or native police.”

      Either way, Hitler did not want an armed resistance so your point is well taken.

  5. I have long thought that a comment from a one time head of the N.J. State Police was interesting, informative too. Before the N.J. State Legislature he offered, “we do not control guns, we control people”, this during Christene Whitman’s governorship.

MOVE to states what recognize and support gun ownership and let the liberals stay behind to figure out how they will pay for all the waste in their government they created when a majority of the taxpayers LEAVE

  7. Hopefully the Court will Overturn their CRIMINAL PROTECTION LAWS IN NEW JERSEY, and let LAW ABIDING CITIZENS, who go through extensive background checks, THE LEGAL RIGHT TO PROTECT THEMSELVES !!!!

  8. I am very happy that the NRA is finally doing something in New Jersey. DC’s carry law was turned over by the Supreme Court over six months ago. Maybe because Beck is up for reelection now they want to do something here in NJ. I hope the courts wake up and smell the coffee

  9. I was born and raised in New Jersey. It is the most thoroughly corrupted place in America. The judges, the prosecutors, the courts, the police and the DMV. I have watched it happen time after time. If you have enough money you can do anything. If you are poor you will get busted for a BB-Gun. A drunk cop driving 110 gets a finger shake. I have tickets for 52 in a 50. I was found NOT GUILTY of careless driving, but then CHARGED and convicted of no seatbelt. (but it was on) The whole thing is a bad joke, and until that is cleaned up, nothing will change. It is a cess pool.
    I could go on for hours, but you get the idea. If you don’t, you are part of the problem.

  10. I grew up in south Jersey in the sixties through 1993. Was raised as a teenager to hunt with my father. Got married at 19. My wife was sexually assaulted in a park ( city park- Millville ) in 1988. The guy that attacked her left teeth marks on her breast enough that you could see each tooth mark and had ripped her clothes and I went to the local police station to inquire about a handgun carry permit. I was actually laughed at. The fella behind the glass( bullet proof I’m sure ) said “let the police take care of any problems” and that they don’t issue handgun permits PERIOD!
    I had my wife tell me she saw this guy again and that he followed her to a store until she ran inside. I carried a loaded shotgun for several weeks in my car, but it would have been prison for me if I had gotten stopped. Not because I would have robbed or assaulted anyone , but because I was protecting my self and my wife as my God given right, not a state given Privilege.
    It’s a shame Chris Christie couldn’t have made NJ a shall issue state. I’ll carry anywhere I go, as the 2nd Amendment is my CARRY PERMIT.

  11. I left the “garbage state” 30 years ago and haven’t looked back since. It is nothing more than a nazi controlled police state from hell only to continue to ILLEGALLY strip it’s citizens from their constitutional rights…and money. Even if anjrpc wins the lawsuit, this communist state will continue to resist, restrict and make any inquiry from a civilian to legally possess a firearm downright impossible, the application wait time right now is a discouragement enough, and that will only be amplified longer if the state loses some “control” over the peoples God given right to bear arms, not to mention what more restrictions these anti-American thugs will cook up if so, the state is too far gone off the deep end, and white folks are the minority now there, just the way the state likes it. NO resistance, only complacency like Renee states in her little fake bubble world of stupidity. I live just across the border where “America Starts” and we blast brass away to our hearts content and there is no “gun” crime here at all, because the criminal knows that they aren’t the only one armed and just that thought is enough of a deterrent to keep your family safe and to live in peace, the way our forefathers intended us to.

  12. While I totally support the 2nd Amendment and I am in support of these legal action, I do however have some concerns with issuing “carry permits” without some much needed requirements. Having been in LE for over 33 years and holding the position of Range Master and Tactical Firearms Instructor. I speak from experience when I say that most of the members of the gun club I belong to are much better shots than the Police Officers I have overseen at the required bi-annual firearm qualifications. Most of us club members shoot far often and fire thousands more rounds than do most Police Officers. Most Police Officers look forward to qualifying as much as going to the dentist! That being said I have to mention that Police Officers (both active and retired) are held to a higher standard during qualifications and must do so during day and night (dark) hours. Police Officers also undergo weeks of Deadly Force Training and must update that training every year. With that in mind I support the right to carry with a few requirements that make total sense. I will list them in order :
    1 – Criminal Background Check (already in place).
    2 – Mental Health Check (already in place).
    3 – Proficiency Course / Test ( Both in Use Of Force and Range Time).
    4 – Annual Qualification Course ( As Retired LE I must qualify TWICE a year).
    5 – Motor Vehicle violations (severe) will show lack of responsibility and loss of PTC.
    6 – Criminal Conviction voids PTC (not hard to understand).

This is idiotic… why are they going after the carry laws and not even bothering with the highly unconstitutional, deeply entrenched draconian process that you have to go through to even buy a firearm in the first place? To buy a gun, you have to apply at the police station for a permit, and people usually wait months… shouldn’t we first fight to get rid of that system??
