Idaho: Important Self-Defense Law Now in Effect

Fairfax, VA – -(Ammoland.com)- On July 1st 2018, Idaho Senate Bill 1313 went into effect. This important piece of legislation, which improved the ability of law-abiding citizens to defend themselves in Idaho, was passed by the legislature earlier this year and became law in March.

Your NRA thanks Senator Todd Lakey and the Idaho Legislature for strengthening Idaho’s self-protection laws.

Senate Bill 1313, sponsored by Senator Todd Lakey (R-12), consolidated and codified existing law to clearly protect the inherent right of a person to defend themselves.

This legislation clarifies that in the exercise of self-defense, a law-abiding citizen may stand their ground and protect themselves or their family anywhere they have a legal right to be.

SB 1313 also protects the right of a person to defend themselves against intruders who enter the defender’s home or business unlawfully or by force, without the defender having to demonstrate that he reasonably feared that the intruder was about to cause death or great bodily harm.  The unlawful or forceful entry is now enough to establish a legal presumption that the defender’s fear of serious injury was reasonable—and, therefore, that the defense against the criminal was reasonable as well.

    1. I agree, every state should allow a US Citizen to defend him or herself without any repercussions from liberal/communist.

  1. Compliments are in Order for the State of Idaho for implementing this much needed law , This should be passed nation wide Every one should have the right to defend themselves against barbarians and thugs contrary to the brainless freaks who want GUN CONTROL leaving honest citizens unable to defend themselves against barbarians terrorists and a Government gone crazy with power and control

  2. Just wondering how all the comments posted can have time stamps of: 7 July 2018, after 8PM (2000hrs). when it is not even noon (12PM or 1200hrs) on 7 July 2018 DST. Is this another oversight/example of people with their heads stuck up into a dark orifice with a fecal odor? I know you will not reply or post this, but be advised…we are paying attention, and cannot put trust in sites/people after such blatant “misprints”.

  3. Apparently you need to reset your clock: It is 14 hrs too fast. My recent post time stamped at 933PM< 7 July 2018; when, in fact, it is only 1133AM (1133hrs), 7 July 2018. If you can;t get the time right, how can you get the news right?

  4. Everyone that says this law is good for Idaho is either a liar or completely ignorant of the politics going on in Idaho…This shit bill was supported and passed with the help of the traitors at the NRA. This bill did not change ANY law in Idaho that was not already there…This law only REWORDED the already existent law….The REAL bill HB.444 which was put together WITH the help of the NRA and professional self defense attorneys and worked on for over 4 years along with the help of GOA and the Idaho 2nd Amendment Alliance was not even allowed to go to a vote because of anti-gun RINOs and the NRA REFUSED to support it after helping put it together….The main RINO in committee was voted out along with some other anti-gun RINOS this year…so now we can truly pass a REAL Stand-You-Ground-Law…..DO NOT PRAISE S.1313….for those here in Idaho in the KNOW…it is a shit bill….

    1. DG,
Please post a link or material with the contents of HB 444 and SB 1313. So those of us not from Idaho may gain for ourselves or at least understand your view as to SB 1313 being a sh!t bill. Thank you.

      1. Mr. Baker,
I too am showing a lengthy difference on the posted time stamp for my post to DG. Post claims 9 July, 2018 8:28am actual is 8 July, 2018 9:28pm. 11 hour difference does seem sketchy. Perhaps it is a review period used to censor our posts. If I am not sure I trust this news source anymore. Thank you for your attention to detail Mr. Baker.

  5. All states must follow and adapt this law . Its crutual that all law abiding citizens be allowed to defend themselves and their loved ones against a intruder should the need arise. Like President Trump would say, make America great again.

    1. Sorry for your luck there Brother but I don’t think they will be passing a law like that anytime soon. My advice to you would be “GET THE HEL- OUT OF THAT “SHI-HOLE” OF A COUNTRY ASAP!”

    1. I wish I could offer you a solution, I “too” would say…”GET THE HElL- OUT OF THAT “SH!T-HOLE” OF A COUNTRY ASAP!” But, “I” would use >SH!T-HOLE” OF A foreign COUNTRY”…I “do” realize, easier SAID…THAN DONE. Be Safe.

    1. Well, up dare in da great white north….Bad mouthing an ACTUAL LEADER that UNDERSTANDS, “other countries” have BEEN taking advantage “of” US, may… not be too cool.
WE tend to be THE MOST forgiving & GENEROUS on the PLANET. People are trying HARD to CAUSE DIVISION to OVER-THROW our government, aka… SOCIALIST/COMMUNISTS ie DEMONcRATS and 97% of the “FAKE” friends & FAKE alLIES.

  6. Way to go Idaho! Here in NJ, if someone breaks into my house, I think I have to offer the poor misunderstood criminal a cup of coffee!
