Who’s likely to fill Ruth Bader Ginsburg‘s crucial seat on the U.S. Supreme Court if Joe Biden wins?

While Senate Majority Leader Mitch McConnell says he intends for President Trump’s nominee to get a vote on the Senate floor, Biden and other leading Democrats say the next president should make the pick.

Based on reporting prior to Ginsburg’s death Friday, here are some of the top contenders for the nation’s highest court if Biden becomes president.

TOP CONTENDERS TO FILL VACANT SUPREME COURT SEAT INCLUDE CONEY BARRETT, HARDIMAN

Biden has pledged to appoint a Black woman to the court if elected. Only five Black women are judges on federal appeals courts around the country, and each is 68 or older this year, according to a Federal Judicial Center database.

SUPREME COURT JUSTICE RUTH BADER GINSBURG DEAD AT 87

This list was compiled from a number of sources, including officials with close ties to the Biden campaign. Recent White House administrations have quickly begun compiling an informal list of possible Supreme Court nominees to consider in the event of a sudden vacancy, but serious vetting only begins when such a vacancy occurs or is announced in advance.

Judge Sri Srinivasan, D.C. Circuit, U.S. Court of Appeals, Washington

Born in 1967 in India, he was named to the appeals court in 2013 (97-0 vote) and is now chief judge. He was a finalist for the Supreme Court seat that Merrick Garland was nominated for by President Obama in 2016.

The son of Indian immigrants and raised in Kansas, Padmanabhan Srikanth Srinivasan was the principal deputy solicitor general at the Justice Department and argued more than two dozen cases before the Supreme Court. He would be the high court’s first Asian-American. He clerked for Republican-nominated federal judges Harvie Wilkinson and Justice Sandra Day O’Connor. Obama called him “a trailblazer who personifies the best of America.” Known as low-key, practical, and non-ideological, he may not excite many progressives, nor give conservatives much to dislike.

Fun fact: Justice Elena Kagan (both worked together in the Obama SG’s office) has praised him, saying Srinivasan at oral argument “cools it down” with his calm manner.

Justice Leondra Kruger, California Supreme Court

Born in 1976, the former deputy assistant attorney general in the Obama Justice Department has argued 12 cases before the Supreme Court. Kruger clerked for Justice John Paul Stevens. Given her sterling resume and relative youth, she would be a strong favorite for a Supreme Court seat if Biden holds to his campaign pledge to nominate an African-American woman.

Considered something of a moderate on California’s high court, she often been a “swing” or deciding vote in close cases. But state judges rarely receive serious consideration for seats on the U.S. Supreme Court — the last was Sandra Day O’Connor in 1981. Kruger’s parents are both pediatricians; her mother is Jamaican, her father Jewish. She had a daughter in March 2016.

Judge Paul Watford, 9th Circuit U.S. Court of Appeals, chambers in Pasadena, Calif.

Born in 1967, Watford’s age and race (African-American) have made him a favorite among some liberal court watchers. Named to the appeals court in 2012, he was a finalist for the nomination that went to Garland.

Clerked for conservative-libertarian former federal Judge Alex Kozinski on the 9th Circuit, and later for the liberal Ginsburg. He was a former federal prosecutor and law firm partner. Supporters call the Orange County native an ideological moderate, which may not sit well with progressives seeking a stronger liberal voice. But his rulings limiting police discretion in search and seizure cases have been applauded by left-leaning advocates.

Judge Ketanji Brown Jackson, U.S. District Court, Washington.

Born in 1970. Jackson was appointed to the bench in 2013. She served on the U.S. Sentencing Commission and was a law clerk for Justice Stephen Breyer. A surprising finalist for the seat that went to Garland.

Presided in 2019 over dispute between former White House Counsel Don McGahn and the House Judiciary Committee, which sought to enforce a  subpoena against him. Jackson rejected the administration’s claim of “absolute immunity,” concluding “presidents are not kings.” Jackson may be elevated to a federal appeals court seat before serious consideration again for the high court.

Fun  fact: Her husband, Patrick Jackson, is the twin brother of former House Speaker Paul Ryan’s brother-in-law William Jackson. The Wisconsin Republican supported her nomination to her current job:  “Our politics may differ, but my praise for Ketanji’s intellect, for her character, for her integrity is unequivocal. She’s an amazing person, and I favorably recommend her consideration.”

Judge Patricia Millett, D.C. Circuit, U.S. Court of Appeals, Washington

Born in 1963. Named in 2013 to a bench considered a stepping stone to the high court — where four current justices once served. Formerly a private Washington-based appellate attorney — President Obama called her “one of the nation’s finest” — who also had more than a decade of experience in the U.S. Solicitor General’s office.

Millett argued 32 cases before the Supreme Court, second-most ever for a female lawyer. Sources from both ideological stripes call her fair-minded, no-nonsense and non-ideological. A top contender for the Ginsburg seat.

Fun fact: Her husband is Navy reservist Robert King, whom she met at a Methodist Church singles event.

Judge Jacqueline Hong-Ngoc Nguyen, 9th Circuit U.S. Court of Appeals, chambers in Pasadena

Born in 1965 in Dalat, Vietnam, she was named to the court in 2012 after two years as a federal district court judge. She could make history as the high court’s first Asian-American justice. She is already the first Asian-American woman to sit on a federal appeals court.

A former state judge, federal prosecutor and private attorney, Nguyen moved with her family to the United States when she was 10, just after the fall of then-South Vietnam to the Communists. Her parents eventually set up a doughnut shop in North Hollywood.

Judge Mary Murguia, 9th Circuit U.S. Court of Appeals, chambers in Phoenix

Born in 1960, Murguia was named to the appeals court by President Obama in 2010, after serving as a federal district court judge in Arizona. The Kansas native is the daughter of Mexican immigrants. Her twin sister is noted civil rights leader Janet Murguia, and her older brother, Carlos Murguia, is also a federal judge.

Judge Jane Kelly, 8th Circuit U.S. Court of Appeals, chambers in Cedar Rapids, Iowa

Born in 1964. She is only the second woman to serve on the St. Louis-based court, appointed in 2013 (96-0 vote). Kelly spent most of her legal career as a federal public defender in Iowa. One of her biggest fans is a fellow Iowan, Republican Sen. Charles Grassley, the ranking member on the Judiciary Committee.

Fun fact: She graduated in 1991 from the same Harvard Law School class as Obama.

Lisa Madigan, former Illinois attorney general

Born in 1966. Now a private attorney in Chicago, Madigan was the state’s highest law enforcement official from 2003-19. She is the adopted daughter of longtime Illinois House Speaker Mike Madigan. A former state senator, she worked down the hall from fellow lawmaker Obama. She gained national prominence after seeking a motion to have former Gov. Rod Blagojevich temporarily removed from office in 2008. She also argued a search and seizure case before the justices in 2004. Her ties to Obama, political skills and law enforcement background have made her a favorite.

Judge David Barron, 1st Circuit U.S. Court of Appeals, Boston

Born in 1967. Barron joined the federal appeals court in May 2014. He formerly served as acting assistant attorney general in the Obama administration, then became a Harvard Law School professor. He clerked for Justice John Paul Stevens.

Being a white male will likely hurt his chances in a Biden administration.

Judge Robert Wilkins, D.C. Circuit U.S. Court of Appeals, Washington

Born in 1963. The Indiana native was raised by a single mother and graduated from Harvard Law in 1989. He filed a civil rights lawsuit in 1992 against the Maryland State Police after being pulled over for speeding, after officers were instructed to focus on young black males when making traffic stops.

Justice Mariano-Florentino Cuéllar, California Supreme Court

Born in 1972 in Mexico. Nicknamed “Tino,” Cuellar served in the Obama and Clinton administrations, and is a former academic specializing in administrative law. He is married to federal Judge Lucy Koh (see below).

Judge Lucy Haeran Koh,  U.S. District Court for Northern California, based in San Jose

Born in 1968. Her 2016 nomination to the 9th Circuit federal appeals court expired with the end of the 114th Congress, and President Trump subsequently named someone else to the seat. She may again be nominated to that regional court before getting serious consideration for the high court.

The Oklahoma native is of Korean descent. Koh had been overseeing separate multi-district litigation involving such tech giants as Samsung and Apple. She is married to state Justice Mariano-Florentino Cuéllar (see above).

Justice Goodwin Liu, California Supreme Court

Born in 1970 and of Taiwanese descent. A former Ginsburg law clerk, Liu helped draft the justice’s dissent in Bush v. Gore. Joined the state high court after twice being rejected in 2011 by Senate Republicans for a seat on a San Francisco-based federal appeals court. He was eventually filibustered, after conservatives said Liu was “outside the mainstream,” expressing concerns over his past statements on a variety of hot-button topics, such as same-sex marriage and health care reform.

A Liu nomination would be among the most contentious made by a Democratic president.

Judge Cheryl Ann Krause, 3rd Circuit U.S. Court of Appeals, Philadelphia

Born in 1968. She was a law clerk for two Republican appointees, including Justice Anthony Kennedy. Named to her current seat in 2014 by Obama.

Kathryn Ruemmler, former Obama White House counsel

Born in 1971.Ruemmler left her government position for private practice in 2014, and is now a private attorney in Washington. As a federal prosecutor, she most famously helped lead the prosecution in the Enron fraud case in 2006. She earned high praise in the White House for helping spearhead legal defense of the health care overhaul bill championed by Obama, whose constitutionality was ultimately upheld by the Supreme Court.

She also shepherded the Elana Kagan and Sonia Sotomayor high court nominations through the Senate. She has no judicial experience, but that wouldn’t be a first. President George W. Bush tapped White House counsel Harriet Miers for the Supreme Court, but she later withdrew from consideration.

Letitia James, New York attorney general

Born in 1958. Elected in 2018, she became the first African-American and first woman to hold the position. James has been very active filing lawsuits against the Trump administration — more than 20 in 2019 alone– over its health care, coronavirus and immigration policies. Some of the litigation has been in coordination with other blue-leaning states.

In August, she sued the Trump Organization, seeking records of its business dealings. Her office also separately sued the National Rifle Association over its finances. Despite support from liberal advocacy groups, her age may preclude her from serious high court consideration, especially since she lacks judicial experience.

Xavier Becerra, California attorney general

Born in 1958.  Left a congressional seat representing downtown Los Angeles that he had held since 1993, to take his current post in 2017. He became the first Hispanic attorney general, succeeding Kamala Harris. Becerra has been very active in suing the Trump administration, especially on immigration matters. Like James, his political savvy and progressive props may be offset by his age and lack of judicial experience, when it comes to a possible Supreme Court nod.

Sens. Cory Booker, D-N.J., and Amy Klobuchar, D-Minn.

A few members of Congress typically get mentioned on these lists, often as a political courtesy, especially to those senators that would vote on any nomination.

Worthy of consideration are two members of the Senate Judiciary Committee (and former 2020 presidential candidates) who gained national prominence during the Justice Brett Kavanaugh confirmation hearings: Booker (born 1969), the former mayor of Newark and one of three current African-American senators; and Klobuchar, (born 1960), a former county prosecutor and adviser to former Vice President Walter Mondale. Klobuchar was considered as a possible vice presidential candidate with Biden, and has been mentioned as a possible Supreme Court pick since 2009.

    Tim, 39, who played a guard at Arkham Asylum in the movie, said Todd Philips’s new
    film has ‘no plot’ and admitted he knew it was ‘going to bomb’ while
    filming. 

    Speaking on The Joe Rogan Experience podcast, Tim said: ‘It’s the worst film ever made.

    ‘I think what happened, after the first Joker, there was a lot of talk
    like, ‘Oh, this was loved by incels. This was loved by the wrong kinds of people.
    This sent the wrong kind of message. Male rage! Nihilism! All these think pieces.

    The follow-up to the Oscar-winning 2019 film, starring Joaquin Phoenix as Arthur Fleck (Joker) and Lady
    Gaga as Lee Quinzel (Harley Quinn), faced negative reviews from
    critics before its October 4 release and flopped at the box office

    ‘And then I think, ‘What if we went the other
    way,’ and now they have Joaquin Phoenix and Lady Gaga tap dancing to a point where it’s
    insane.’

    He continued: ‘It has no plot. We would sit there, me and these other guys
    were all dressed in these security outfits because we’re working at
    the Arkham Asylum, and I would turn to one of
    them and we’d hear this crap and I’d go, ‘What the f*** is this?’ And they’d go,
    ‘This is going to bomb, man.’ I go, ‘This is the worst thing I’ve ever seen.’

    ‘We were talking about it at lunch, and we’d go, ‘What is the plot?
    Is there a plot? I don’t know, I think he falls in love with her in the prison?’ It’s
    not even hate-watchable. That’s how terrible it is.’

    Despite the negative reviews a number of fans of the sequel took to social media
    after its release last month to defend the sequel
    to Todd Phillips’ 2019 motion picture.

    The film debuted to a paltry $40 million at the domestic box office, good enough for the weekend’s top spot,
    but less than projections, and half that of its predecessor.

    Amid the early returns, a number of fans took up for the movie and its cinematic depth, in breaking away from the cookie cutter
    nature of sequels to introduce a musical element not present in the first film, with Lady
    Gaga joining the franchise.

    ‘Joker 2 was amazing,’ one user said, adding that it was ‘100% as divisive
    as people are making it out to be. I love that the film didn’t try to
    be a traditional sequel, and fully committed to the storytelling they presented.
    It never deviated to be a film full of Easter
    eggs or any other crowd pleasing aspects.’

    Another user said, ‘I kinda loved Joker 2.

    I loved how it was structured as a meta-exploration of the
    first film’s fandom and the musical elements were a lot of fun.’

    Despite the negative reviews a number of fans of the sequel took to
    social media after its release last month to defend the sequel to Todd Phillips’ 2019 motion picture 

    One user marvelled that Joker 2 is ‘getting universal hate
    despite being more interesting and creative than anything marvel has done in years is expected.’

    It comes after lead star Lady Gaga was left ‘disappointed’ at the immense flood of negative reactions to Joker:
    Folie à Deux, with the singer’s team now keen to quickly push
    out other projects to help distract from the furore over the film,
    insiders claim.

    Todd Phillips‘ sequel has bombed, raking in just under
    $40 million at the domestic box office, and receiving the lowest CinemaScore in comic book movie history.

    Gaga, 38, is reportedly confused at the lack of love for her
    turn as Harleen Lee Quinzel, aka Harley Quinn, alongside Joaquin Phoenix, 49, as the Joker – a role that
    won him the best actor Oscar in 2019 – in the wake of
    the standing ovation it received at the Venice Film Festival last month.

    ‘Gaga is surprised by the response to Joker 2 and is shocked that people don’t love it after the response it received from critics before
    it premiered,’ a source exclusively told DailyMail.com. 

    ‘She put so much heart into the movie and
    has so much respect for the DC comics fan base.’

    They added: ‘Her team is quietly looking at other projects they
    can roll out as they want to move on this from as quickly as possible.’

    It comes after lead star Lady Gaga was left ‘disappointed’ at the
    immense flood of negative reactions to Joker: Folie à Deux, with the singer’s team now keen to quickly push
    out other projects to help distract from the furor over the
    film, insiders claim

    But despite the lacklustre reception from fans, a second source claimed she is not letting
    it deter her from returning to the big screen, with the singer said to be eyeing up a Quentin Tarantino movie.

    ‘She is disappointed that Joker is pretty much a bomb,’ they said. 

    ‘She thought that this film could get her an Oscar nomination, especially since the first film
    was such a success and Joaquin won an Oscar.

    ‘She would now like to land a role in Quentin Tarantino’s next

    IndieWire’s David Ehrlich took a bit of a harsher tone, saying the 138-minute flick is ‘boring, flat, and a
    criminal waste of Lady Gaga,’ adding it
    feels ‘bad on purpose.’ 

    He added: ‘Phillips has created a corporate pop spectacle that all
    but demands to be seen as something else. 

    ‘Here is a movie that perversely denies audiences everything they’ve been conditioned to want from it; gently at first, and then later with the unmistakable hostility of
    a knife to the gut. 

    ‘And that, more than anything else, is why Folie à Deux adopts the form of a classic musical: Because no other
    genre makes it so easy to appreciate all the fun you’re not having.’ 

    In contrast, Alex Harrison of ScreenRant describes Joker: Folie à Deux
    as a more refined sequel designed to provoke fans of the original film. 

    ‘Joker: Folie à Deux has more coherent things to say about fan culture than it
    or its predecessor does about mental illness,
    which, for me, makes it the superior of the two,’ he stated.

    Deadline’s Pete Hammond praises the film as ‘brilliant’ and lauds the performances of the leads. 

    ‘Phoenix knows this character inside and out, and in what others might
    say is a risky proposition, he tap dances, sings and sells this role
    like no other — if not topping his Oscar-winning turn in Joker, at least finding a way to take him in different, wholly surprising direction. 

    ‘Gaga is smartly low-key, not the Harley Quinn we associate with Margot Robbie, but her own person, dressed
    down and believably showing affection and connection with Joker and, more important, the man behind the makeup.’

    The Hollywood Reporter says Joker: Folie à Deux feels ‘narratively a little thin and at times dull… This
    sequel is built on more of a conceit than a solid story foundation.’

    ‘Even more than its predecessor, Joker: Folie à Deux
    reduces the archvillain to a hollowed-out product of childhood trauma and mental illness.
    Which means there’s little we didn’t learn last time,’
    added the outlet’s David Rooney.

    The Guardian’s Peter Bradshaw wrote, ‘There’s a great supporting cast and a barnstorming first act
    but Todd Phillips’s much-hyped Gotham sequel proves claustrophobic and repetitive.’

    Joker: Folie à Deux is set to be released in theaters on October 4,
    2024. 

    It is the much-anticipated follow-up to 2019’s Academy Award-winning Joker, which earned more than $1

    highest-grossing R-rated film of all time.

    Joaquin has revealed he ‘almost lost his mind’ after surviving on a diet of ‘lettuce,
    asparagus and apples’ to lose three and a half stone to play The
    Joker (Seen left in the film and right at Venice Film Festival on Wednesday)

    The last time that actor Joaquin Phoenix played The Joker, Arthur Fleck, he had to drop three and a half stone – and he has revealed he had
    to do so again

    He added: ‘I know I was responsible last time for talking about it, but it’s difficult to do so. 

    ‘That becomes your obsession because you’re working the entire time to get to a certain weight.

    ‘So then you end up talking about it, and then it just sounds like an actor going on and on about how much weight they lost.

    ‘By the end of that run I was so sick of myself and angry
    at myself for making such a big deal about that part, because
    you just do what you’re ****ing supposed to do. So this time I was like, ‘I’m not going to do that’.’

    He then whispered: ‘It was 47 pounds,’ before adding: ‘No, I’m joking.
    I don’t know.’

    Co star Lady Gaga, who plays a music therapist at Arkham Asylum,
    said: ‘We rehearsed the waltz in the film for two months which kind of falls apart. 

    ‘When Joaquin was too hungry we fed him blueberries.’

    Phoenix said: ‘Part of the joy for me was to take standards and find a way that was specific to the characters. 

    ‘That was part of what was interesting for us. We started off with references like
    Frank Sinatra and Sammy Davis Jr and we started to emulate that sound.’

    Speaking at the Venice Film Festival he said: ‘I’m not going to talk through specifics
    of the diet, because I just think nobody wants to hear that’

    Five years after the first film, he has returned to the Oscar-winning role
    again in Joker: Folie a Deux – and says that he had to lose almost the same amount of weight once more, and is never doing
    it again (Seen left before filming in 2018 and right after)

    ‘But this time, it felt a bit more complicated just because there was so
    much dance rehearsal that we were doing, which I didn’t have last time,’ Joaquin said of the
    weight loss this time round 

    Joaquin’s weight loss for the first film somewhat ‘obsessed’ with his weight where he also developed a
    ‘disorder’ over pounds (Seen left in the first film and
    right ahead of filming)

    He added that his co-star Lady Gaga, real name Stephanie Germanotta ‘wanted to sing live and I did not.
    In the end, every part of the recording was
    live.’ 

    Gaga said: ‘The way music is used is to give characters a way to express themselves
    because the dialogue is not enough.’ 

    She had to forget her professional training: ‘It was about unlearning technique and forgetting how to breathe.’

    Director Todd Phillips said that he felt the pressure after the success of The Joker. 

    He said: ‘I’m more nervous of this one than the first one.
    The first one we were under the radar, this one everyone was writing on the internet
    about it.’

    The Warner Bros film is released on October 4th.

    After the release of the first film, Joaquin shut down rumours he only ate an apple a day to achieve his astonishing
    weight loss, telling Access Hollywood that he consumed more food than that
     ⁠— though not much more.  

    ‘It wasn’t an apple a day. No, you’ve also got lettuce
    and steamed green beans,’ he said of what he ate in preparation for the
    role. 

    The actor previously admitted that ‘you start to go mad when you lose that amount
    of weight in that amount of time’

    While speaking with Access Hollywood, Joaquin explained he consulted with a doctor to ensure he lost weight
    as safely as possible

    Although Joaquin has lost weight for roles before, he admitted that ‘Joker’ director Todd Phillips didn’t make it easy on him. 

    The Her star recalled how the producer always had the one food item he craved on hand, which made his diet a bit more of a struggle. 

    ‘Todd did have these f*****g pretzels that I love. And he’d just
    have bags of them in his office!’ he said. ‘And that was difficult.’ 

    Joaquin’s character is wearyingly thin in the film, and he admitted that he had
    reservations about taking on such a drastic weight loss. 

    ‘It’s a horrible way to live,’ he told the New York Times.

    ‘I think [the Joker] should be kind of heavy. Todd was
    like, ‘I think you should do the real thin person.”

    Joaquin previously said his extreme diet helped him prepare for
    the role in more ways than one. 

    ‘The first thing for us was the weight loss — I
    think that’s really what I started with,’ he said of working
    with the film’s director. 

    ‘And, as it turns out, that then affects your psychology.

    You start to go mad when you lose that amount of weight in that amount of time.’

    The singer – a 13-time Grammy Award-winner – has delighted fans

    The disturbing video for Disease sees her fighting with
    different versions of herself and chained up in a darkened room. 

    The video begins with the star seemingly the victim of
    a car crash as she lies bloody  on the bonnet of a car.

    She then wraps her legs around the other Lady Gaga
    to try and strangle her as the tension intensifies. 

    The scary leather clad character from earlier is then seen vomiting black liquid next to another Lady Gaga who is lying on the crown.

    She is then seen trying to escape the chaos as she gets
    trapped between two closing walls that eventually crush her to death. 

    It comes as Lady Gaga, 38, revealed she was ‘overwhelmed’ by her
    Little Monsters’ reaction to her latest tune Disease.

    The pop superstar said she feels ‘insane joy’ about her fandom’s response to her electro-pop banger – and
    teased that there is ‘a LOT more to come’.
