Earlier this week 10th U.S. Circuit Court of Appeals struck down a New Mexico law that imposed a seven-day waiting period on firearm purchases.
“Cooling-off periods do not fit into any historically grounded exceptions to the right to keep and bear arms, and burden conduct within the Second Amendment’s scope,” Judge Timothy Tymkovich stated in the 2-1 ruling. “We conclude that New Mexico’s Waiting Period Act is likely an unconstitutional burden on the Second Amendment rights of its citizens.”
Cheers to that. I’ve only been here a few months but I get this feeling that we law-abiding gun owners in New Mexico are Road Runner, just minding our business out here in the desert. Governor Michelle Lujan Grisham is like Wile E. Coyote, incessantly scheming and plotting against us with dubious plans that crash out in a laughable manner. For example, in 2023 a federal judge struck down Lujan Grisham’s public health order for the Albuquerque area that temporarily suspended the right to carry concealed weapons in public.
There is no carve-out in the Second Amendment that says, “right to bear arms after an arbitrarily designated waiting period to obtain them.” So I don’t really have to justify my position but just for kicks, I will.
In a statement our governor claimed that, “Waiting periods prevent impulsive acts of violence and suicide, giving people time to step back and reassess their emotions during moments of crisis.”
If someone is going to commit an impulsive act of violence, they don’t necessarily need a gun to do that. Criminals don’t follow gun laws, in part because many such laws aren’t even enforced. I can’t tell you how many times I’ve reported on someone being charged with “felon in possession of a firearm.” A 2018 federal audit of the previous year found 112,000 attempts to purchase firearms by prohibited individuals, only 12,700 of which were investigated. According to a National Review piece by Kevin Williamson, “Here’s the really bad part: Out of those 12,700 cases that were taken up for investigation, there were only twelve prosecutions.”
The people this waiting period law would harm the most are women and the elderly, as they’re the ones most likely to need a firearm for self-defense. A handgun is the great equalizer.
The primary purpose of our Second Amendment is not for hunting pronghorn on the weekends, as much as I want to do that. The Founding Fathers enshrined the right to self-defense in our Bill of Rights to give citizens a way to protect themselves against tyrannical governments — whether they be at the local, state or federal level. That’s why it was so egregious when Ronald Reagan signed a bill in 1986 to ban the sale of new machine guns to civilians.
It should come as no surprise that Joe Biden is a useful foil when you need a quote about gun control. Here’s a common leftist trope Biden belched out at some point during his 150-year stint in Washington, “For those brave right-wing Americans who say it’s all about keeping America independent and safe, if you want to fight against the country, you need an F-15… You need something more than a gun.”
Well that’s a buncha malarkey Jack. Take the Bundy Nevada ranching family as a case in point. Their decades-long dispute with the Bureau of Land Management (BLM), culminated in Ammon Bundy leading a standoff and ultimately a shootout with federal agents at a wildlife refuge in Oregon. Federal charges related to the standoff were dismissed.
We really do need guns to fend off tyrannical governments and angry mobs. Consider how many people the feds killed in the 1990s at Ruby Ridge and Waco. Then in 2020 we witnessed the unconscionable levels of primal violence that leftist mobs were capable of, and the fecklessness of many law enforcement officials — including President Trump (he should’ve listened to Tom Cotton and sent in the Marines).
Anyway, back to Lujan Grisham. In April she signed a bill that allows illegal aliens in the country under DACA (Deferred Action for Childhood Arrivals) to work as police officers. As the Federation for American Immigration Reform noted at the time, these aliens are not permitted to own firearms under federal law. So the next time a cop asks to see your driver’s license, I guess you should ask to see his too. Needless to say, the aristocrat who lives in our governor’s mansion has no legitimacy to make me, a law-abiding citizen and heritage American, wait more than three minutes to purchase a firearm.
Lujan Grisham’s most notable gun control victory came in 2020 when she signed a red flag law, which empowers a judge to take away someone’s firearms for up to one year if they are deemed dangerous to themselves or others. The Heritage Foundation pointed out the statute has an unreasonably low standard of proof and that, “the judge has to be substantially confident the person poses a danger in the future. For a preponderance of the evidence, the judge needs only to be slightly more confident than not that the accused is dangerous.”
This spring the governor signed an amendment to the law that allows for immediate relinquishment of weapons, eliminates the waiting period and necessity of a report from a third party. This red flag law is an assault on the due process rights of people who have not been convicted, let alone charged, for any crimes whatsoever. It’s possible the governor violates our rights from a place of good intentions, but the road to hell is paved with them.
The only respectable argument in favor of gun control I’ve encountered came from Bret Stephens in a 2017 NYT column. His ultimate argument was ridiculous but I respect his intellectual honesty. He acknowledged the fallacies about so-called assault rifles, gun show loopholes and the NRA buying off politicians. It’s all bunk. Stephens cuts right to the chase and explicitly advocates for repealing the Second Amendment. He makes a compelling case that homicide rates would drop substantially. But this path only leads to the violent absurdity of London, which has become infamous for its futile attempts at knife control.
Alternatively, Japan has some of the strictest gun control restrictions in the world. And as CNN reported a few years ago, those policies seem to be working quite well. Yet the CNN leftwing activists masquerading as journalists won’t tell you, or perhaps they don’t know, the uncomfortable truth. Gun control generally works in Tokyo because Japan is an ethnically homogenous country with a culture that aggressively cherishes order. It’s homogenous because their government has consistently enforced hardline nationalist immigration policies that would make Trump blush. Still, even Japanese gun control isn’t airtight. Former Prime Minister Shinzo Abe was tragically shot to death in 2022.
I guess it’s a fun theoretical argument to have with your liberal friend at a coffee shop. But American gun owners, myself included, are not surrendering our weapons. Even by conservative estimates, we have more than 350 million privately owned guns in this country. We also have thousands of patriotic lawmen dedicated to protecting your God-given right to keep them. Firearms are deeply embedded in the fabric of our culture. According to the Brady Campaign, as of 2024 there were approximately 2,000 counties and a dozen states that had declared themselves “2A Sanctuaries.” In 2023, 80 Illinois county sheriffs declared they would not enforce a law signed by Gov. Pritzker that requires citizens to register their semi-automatic rifles with the state.
I frequently find myself asking what, if anything, the nominally conservative politicians I vote for have conserved. The Second Amendment is the only thing that comes to mind, and Supreme Court did most of the heavy lifting. As Democrats become more radical and as America continues to gradually decline thanks to unsustainable mass immigration from the third world, the diminution of traditional Christianity, a decadent system entitlements and the rising $37 trillion national debt; firearms will remain an important lifeline of protection for ordinary Americans if and when things get hairy.
